Host lost Data and denies responsibilty

I wants some opinions about a web host company I used in japan for 5 years. I will name that company later but first I want to get the groups opinion on the facts.

1. We had a dedicated server ran it for 5 years no issue.
2. We paid for back up
3. They decided to upgrade their server, we did not ask for that.
4. They notified us by email they were going to do this.
a. said we had to reset some IP’s we did so.
b. they installed a Cpanel
c. Almost as small side note not listed in the main body in instructions of what to do -“check it”.

5. They claim their automatic software upgraded with success.

I did a quick check as did my tech after we changed the IP and all sites worked as viewed from browser

Then 1/2 the web sites went dead a few weeks later or month later.

Apparently that was when they turned off the old server, so they were still serving from old server apparently.

They deleted the old server despite we paid for backup etc.

So now claim no responsibility.

It was a huge loss to my company , apparently they transferred all the word press sites, but not the joomla sites.

bottom line is this — we did not do anything to the server and the sites , they are the ones who changed server on us and lost 1/2 the web sites. I feel they are 100 % responsible. They claim its a un-managed dedicated server so they have no responsibility.

To me if you go into some ones rented home you own because a clause in the agreement says you can move them to a new home and you move their furniture to a new home. Then you break all the furniture then the owner(you) who makes the move is responsible, not the renter who did not cause the issue. They did this to us by moving us to a new server and lost 1/2 of our web sites.

I mean we did not initiate the move nor cause any of this. We did follow their guidelines they sent us. check the web site—it was there. Certainly no one can check 1000s of files one by one after such a move or can expect one too. Certainly they lost the files and I dont think that makes them not liable for their action.
