When is linking to pirated content allowed?

Just lost my post, will summarize.

When do US-based hosts allow linking to pirate/warez/torrent websites, but not necessarily the naughty stuff? Some of these websites have legal content, including technical data we would like to link to. I realize the term linking to illegal content carries a broad meaning. Any real world examples of what is and what isn’t allowed would be heavily appreciated.

Some categories we thought of

1. illegal content (i.e. Star Wars)
2. legal content (about us)
3. murky area (i.e. charts of most popular downloads)
4. indexed content (crawled)
5. user-submitted content

We’re interested in category 3 but would like to know what is allowed and what isn’t. Searching the interwebz did not help to resolve this question at all.
